OpenAI lawyers question Meta’s role in Elon Musk’s $97B takeover bid 

OpenAI is seeking evidence from Meta about whether it had any discussions with Elon Musk and xAI concerning a potential acquisition or investment in the company, according to a court filing released Thursday.

The filing, part of Musk’s lawsuit against OpenAI, revealed that lawyers for the ChatGPT-maker subpoenaed Meta in June for records linked to Musk’s unsolicited $97 billion bid in February. Whether Meta holds such documents remains unknown. OpenAI rejected Musk’s offer.

Musk’s lawsuit centers on OpenAI’s restructuring of its for-profit division into a public benefit corporation, a change intended to secure investment and prepare for a potential public listing. Musk, who co-founded the company, contends the shift violates its founding principles.

Meta has asked the court to quash the subpoena, asserting that Musk and xAI can supply any relevant information themselves. The company also maintains that its own internal discussions of OpenAI’s recapitalization are irrelevant.
